The family of Angella Vivienne Chebet has petitioned the High Court in Kampala seeking orders to have her produced in court “dead” or “alive”.
Vivienne is the wife of socialite SK Mbuga who was arrested last year over fraud.
Her family wants the court to issue a directive to Inspector General of Police and Director of Public Prosecution to produce their relative.
Mrs Mbuga was arrested on Valentines Day and detained at Katwe Police Station over allegations of defrauding UGX20bn from her former Swedish lover.
Vivienne's brother, in a sworn affidavit, says her sister was transferred to Kira Police Station two weeks ago.
Samuel Mukasa argues that her sister's continued detention is illegal and beyond the 48 hours describes in the constitution.
"As a result of the continued detention, the applicant’s constitutional right to personal liberty is being violated under the guise of protracted investigations yet she secured an order for unconditional release issued by the Chief Magistrate’s Court of Kira."
Vivienne risks being deported to Sweden if foreign lawyers become successful with the paperwork.
