The child will remain dependent for life.
In a ruling delivered by the High Court on Thursday, Nairobi Women's Hospital was further ordered to pay the mother Ksh. 800,000 ($8,000) for the pain and suffering she underwent during labor.
Judge Mbogholo Msagha said the two deserve the awarded compensation due to the horrifying ordeal and the irreversible condition of the child.
“The mother and child would not have found themselves in that situation had prudent and professional attendance been extended to them,” the court ruled.
The mother, Purity Kemunto, narrated how the hospital's medical staff neglected her after being induced into labour but without positive results.
Medical reports concluded that had the labour been monitored, the Caesarean Section would have been done in good time. It further revealed that the child likely suffered Asphyxia and will remain dependent for life.
In March, a woman who was physically abused whilst in labor at a government hospital was awarded Sh2.5 million ($25,000) by a Bungoma court.
